Cancellations

The Company reserves the right to cancel any tour where the minimum number of passengers is not reached. Minimum number of passengers required for tour departure is six. In such cases, the Company's liability to the Customer is either the full return of monies paid for the tour or provision of a suitable alternative tour as agreed with the Customer.

Cancellation Charges

Where the Customer cancels his/her tour reservation, charges will be payable by the Customer as detailed below:

Please note that all Customers cancelling any tour reservation will be charged a standard fee of 10% of the booking price to cover administration costs. The following terms and conditions apply:

1 Day Tours:

  • For cancellations made more than 72 hrs before departure, a full refund will be given less an administration fee of 10%
  • For cancellations made less than 72 hrs before departure, there will be no refund. Customers will be placed on standby for a period of 12 months.

Extended Tours (more than one day):

  • For cancellations made more than 7 days before the tour departure, a full refund will be given less an administration fee of 10%
  • For cancellations made less than 7 days before the tour departure, there will be no refund. Customers will be placed on standby for a period of 12 months.

*No refunds are offered on any tours if the passenger is late for a tour/cannot find the pick-up point*

Arriving for your tour

The check-in for tours OPENS 15 MINUTES PRIOR TO THE PUBLISHED DEPARTURE TIME AND CLOSES 5 MINUTES PRIOR TO THE PUBLISHED DEPARTURE TIME as the coach must depart on time and cannot wait for late-comers. This is for the benefit of all customers, and allows us to visit all stops for the full amount of time, offering you the most out of your tour.

You can find your Published Departure Time on your booking confirmation. Arrival in time for tours departing and finding the departure point are the responsibilities of the customer.

Tour Timings

Please note that return times stated are estimated. Due to the unpredictable nature of travel, we cannot guarantee these times. Please bear this in mind when arranging further travel connections. Company is not responsible for missed travel connections. We strongly advise procuring travel insurance in the unfortunate event that you are unable to reach connecting travel arrangements. 

Minimum Numbers

The minimum number of passengers required for tour departure is 6 passengers, which helps to minimise the impact on the environment. The Company reserves the right to cancel any tour where the minimum number is not reached. On the rare occasion that we should be required to cancel a tour, we will inform the Customer in advance and offer an alternative tour subject to availability, upgrade the Customer to a tour at a higher fare at no extra cost, or provide a full refund.

Insurance

Whilst the Company maintains insurance meeting all statutory requirements, we strongly recommend that passengers hold comprehensive and suitable travel, medical and cancellation insurance to cover for eventualities during travel.

Alterations/Alternatives

The Company reserves the right to alter tour itineraries at any time, due to weather conditions, traffic problems, availability of attractions or other such extenuating circumstances beyond our control. In the case of accommodation, we will attempt to obtain a similar standard of accommodation wherever possible. The Company reserves the right to alter the size and type of motor coach employed on any tour.

Other Operators/Carriers/Third Party Suppliers

The Company will not accept or have any liability for any acts or omissions whether negligent or otherwise of any supplier (including accommodation, subcontracted coach services, tourist attractions, and print communications ) or person providing services in connection with any tour unless such a person is employed by or under direct control of the Company. Tickets and vouchers for travel on other carriers are subject to the normal conditions of carriage of the individual carrier.

Accommodation

Please note accommodation is not included in the tour price. Accommodation arrangements for 2 and 3 day tours are provided independently by third party accommodation providers. Such arrangements are subject to the terms and conditions and limitations of liability imposed by these providers, and as such any contracts undertaken are made between the Customer and the Third Party accommodation provider. All such arrangements are made independently of Company, irrespective of any help and assistance which the Company may provide in securing such arrangements.

Where Customers choose to book their own accommodation, it must be in the town centre or the Driver-Guide will be unable to drop Customers off and collect them.

*Please be advised, most accommodation providers in the Highlands only accept cash payments, and do not accept debit/credit cards as methods of payment. Single supplements will usually apply.

Please note for groups it may not be possible to allocate all rooms in the same Hotel/Guesthouse/Hostel due to high demand.

Extended tours departing from Glasgow

For operational reasons and to minimize the impact on the environment, our 2 and 3-Day tours departing from Glasgow pick up in Edinburgh first and on the return journey, the tour terminates in Edinburgh only. Passengers who were collected in Glasgow and wish to return there, are provided with a valid Edinburgh - Glasgow rail ticket and are dropped at Edinburgh Waverley Rail Station for the return journey to Glasgow.

Luggage on extended tours

Luggage is limited to 1 small to medium-sized suitcase or bag per person.

Prices

Tour prices are for transport and Driver-Guide only. All other attraction entrance fees, cruise tickets, food and drink, accommodation etc, are additional optional extras, payable locally by the Customer at their own expense. Timberbush Tours do negotiate reduced rates at most tourist attractions and historical sites visited for Customers.

The Company’s current published prices on the website and in the current brochures are valid from 1st April 2017 to 16th March 2018.

Concessionary prices are offered to persons over the age of 60, full-time students and children between 5 and 16 years. We regret that children under 5 years cannot be carried.

Children

Regretfully we cannot carry children under the age of 5 years on our scheduled tours. Children aged 5-16 years of age will receive a concessionary rate.

Customer Conduct

  • Smoking is not permitted on any of our vehicles.
  • The consumption of alcohol is not permitted on any of our vehicles.
  • The Company reserves the right to refuse to carry any person whose conduct or manner is likely to cause offence or upset to other passengers. In such cases full cancellation charges to the passenger apply, and the Company shall have no further liability to that passenger.

Force Majeure

The Company does not accept any liability for any loss, inconvenience or damage caused by war, threat of war, riot or civil commotion, terrorist or criminal activity, industrial disputes, natural disasters, fires, illness, weather conditions, road traffic conditions, temporary technical, electrical or mechanical breakdown.

Please note that when giving information for the purposes of making your Booking, you will be deemed to consent to us holding and using that information to send you details of other products and services we provide that we think may be of interest to you. Booking Conditions for Rabbies Tours

Rabbie's Trail Burners Ltd ("the Company") accepts your ("the Customer") booking under the following terms and conditions.

Payment

Reservations will only be confirmed on receipt of full payment.

Cancellations and Refunds

The Company will only cancel tours due to circumstances outwith our control or that might jeopardise your safety. We always refund in full if we cancel your tour. Where the Customer cancels the tour reservation then the effective date of cancellation will be the date the Company receives written notification. In the event of cancellation a charge, as detailed below, shall be payable by the Customer.
If cancellation for extended tours is made less than 3 weeks before the tour commences, refunds are at our discretion. Please also note that customers may be liable for 1 nights accommodation surcharge in this instance. If cancellations are made less than 72 hours before the tour commences, please be advised that customers may be liable for all accommodation costs.

Charges

For All Tours, City Breaks and holidays of more than 1 day
a) Cancellation more than 21 days before the tour date 10%
b) Cancellation less than 21 days before the start of the tour entirely at our discretion.
For 1 Day Sightseeing Tours
a) Cancellation more than 72 hours before tour departure 10%b) Cancellation less than 72 hours before the tour departure entirely at our discretion.

Alternatives/Cancellations

While the Company shall do everything reasonably possible to provide your tour itinerary and details as planned, the Company reserves the right to alter itineraries, transport or accommodation for whatever reason. In the case of hotel accommodation a similar standard of alternative accommodation will be obtained wherever possible.
The Company reserves the right to refuse to carry any person whose conduct or manner is likely to cause offence or upset to other passengers. In such cases full cancellation charges apply and the Company shall have no further liability to that passenger.

Other operators/carriers

The Company will not accept or have any liability for any acts or omissions whether negligent or otherwise of any supplier or person providing services in connection with any tour unless such a person is employed by or under the direct control of the Company. Tickets for travel on other carriers are subject to the normal conditions of carriage of the individual carrier.

Luggage

Unless otherwise notified passengers are restricted to one medium sized suitcase/bag (maximum 20 kilos) and one carry-on bag per person. Luggage is carried free of charge but at the passenger's own risk.

Children

We regret we do not carry children under the age of 5.

Insurance

The Company strongly recommends that passengers arrange suitable travel, medical and cancellation insurance.

Smoking

Smoking is not permitted on coaches but there are frequent stops en route for passengers who wish to smoke.

Financial Protection

In accordance with the EC Directive on Package Travel all customers monies are held in trust until such time as the tour has been completed.

Force Majeure

The Company does not accept any liability for any loss, inconvenience or damage caused by war, threat of war, riot or civil commotion, terrorist or criminal activity, industrial disputes, natural disasters, fires, sickness, weather conditions, road or traffic conditions, temporary technical, mechanical or electrical breakdown within booked accommodation, explosion of, or radioactive contamination from, any nuclear facility or other events beyond the control of the Company.

Jurisdiction

These conditions shall be construed and interpreted in accordance within the Law of Scotland and the Parties each submit to the jurisdiction of the Scottish Courts.

Helpful Hints for Booking Tours

Guaranteed Tours

Particularly during the winter months, not all tours will run if there are not sufficient people booked on the tour for a specific date. There is often a minimum of at least 5  people required. However, we do have some tours that are guaranteed to run no matter how few people there are, so if you book, you go! So if you are considering a tour during the winter months, look for a tour that says 'Guaranteed'.

Payments

When booking a tour, full payment is normally required. This can be done by credit or debit card (credit cards often incur a transaction charge) during the booking process. We strongly recommend that you take out appropriate travel insurance should you ever have to cancel your holiday.

Accommodation

For the overnight tours that include accommodation, in general you will be given a choice of accommodation, either guesthouse or hotel. Guesthouse accommodation will be family run guesthouses  within walking distance of the city centre. The rooms will be ensuite or have private facilities. Hotels are normally 3 star good quality hotels with ensuite rooms. Both hotels and  guest houses offer TV, tea and coffee facilities amongst other features. A double room is a room with one large bed for 2 people. A twin room is a room with two single beds. A single room accommodates one person.

For extended tours that don't include accommodation, the tour operator can book accommodation for you, which you pay for when you arrive there. You'll be given a choice of hostel, guesthouse, or hotel accommodation. Simply enter your choice of accommodation during the booking process.

Stops during the tour

There will be frequent stops during the tours, and normally you won't be travelling for more than 2 hours without a stop. The coach or bus will stop for photo opportunities during the tour, as well as stopping for lunch and tea or coffee breaks. Lunch isn't included in the tour price, but the lunch stops are normally in places where there's a good choice of food outlets.

Luggage

For the coach tours is normally restricted to one large suitcase and one carry-on bag per person. The minicoach tours are limited to what luggage they can carry - normally one medium suitcase per person.

Booking Conditions for Heart of Scotland Tours 2012

HEART OF SCOTLAND DAY TOURS - TERMS AND CONDITIONS
 

Acceptance of the conditions detailed below as per Scottish Law and Custom is implied when a booking is made.

  1. Payment - we accept Visa, Mastercard, Visa Debit, Solo, JCB and Visa Electron cards
  2. Children and Families - we are happy to carry children (5-12 years) who are charged at the concessionary rate. Please inform us age and approximate weight of all children 5-12 years. You must contact us before booking if you would like to bring under 5’s so we can advise as to suitability of tour and make arrangement for their safe transport. We reserve the right not to carry children under 5 years unless prior arrangements have been made.
  3. Tours - the price quoted for each tour is inclusive of transportation and guiding only. Lunch and other refreshments are not included. Entrance fees to attractions are not included although reduced prices are sometimes available.
  4. Smoking - smoking is not allowed on the mini-coach.
  5. Behaviour - we reserve the right to refuse to carry any person or persons whose behaviour is causing offence or alarm to others. In such cases full cancellation charges will apply.
  6. Vehicles - we reserve the right to change the type of mini-coach used if the circumstances dictate this is necessary.
  7. Luggage -luggage is limited to one small item per person.
  8. Alterations to Itineraries - we reserve the right to change timetables or tour itineraries due to weather, availability of attractions, roadworks or any other situation beyond our control.  Refunds will not be offered in these circumstances.
  9. If you book online within 24 hours of departure you MUST also phone us to confirm your booking.
  10. Cancellations and refunds - where the passenger cancels a tour reservation, the effective date of cancellation will be the date on which we receive notification by telephone, email or in writing.  Your notice of cancellation must be confirmed (in writing or verbally) as received by Heart of Scotland Tours to be effective.  No refunds are offered if a customer is late for a tour/cannot find the pick-up point. Please be there 15 mins before the advertised departure time. Cancellation charges for 2012/13 are applied as follows:
    1. Within 24 hours of departure date - 100% of full cost
    2. Within 2 - 5 days of departure date - a full refund will be granted by Heart of Scotland Tours if the seat can be resold. Every effort will be made to resell the seat but a 50% charge will be applied if the seat cannot be resold. In the event of a tour being cancelled by Heart of Scotland Tours the customer will be fully refunded and every effort made to find a suitable alternative.
  11. Complaints - all complaints should be initially directed to your driver/guide who will make every effort to resolve the problem. In the event that a complaint cannot be resolved on the day of the tour then it should be made in writing to This email address is being protected from spambots.   12. Travel insurance is recommended.

Minimum age policy

The minimum age for our scheduled tours (Tours 1-7) is 5 years old. Please be aware there may be extended periods of travelling and the longer tours, in particular, may not be suitable for children especially if they are unfamiliar with English or too young to be distracted by the driver guide's stories.

Breaks may be very short on some tours, anything from 15-45 minutes. Photostops may be as short as 5 minutes, or cancelled due to delays.
There are no changing facilities on the vehicle, so please check that the rest stops will be frequent and long enough if you are travelling with kids..

Passengers with children will be allocated seats where they will not be a distraction to the driver/guide.

An accurate age for any child travelling is required so the correct and legal type of seating can be installed. An incorrect age entered will result in a refusal to travel, so extra care must be taken when entering these details into your tour requirements. A child having an unpleasant experience on a tour can result in everyone having an unpleasant time, so every care will be taken to make sure this does not happen. The booking office can advise you on the tours most suitable to the age group, language abilities and rest stop needs for your child. Accurate information on your child's needs will be most helpful in determining which tours will best suit you and your child.

Cancellation and Refunds for scheduled tours

When a passenger wishes to make a cancellation of a scheduled tour the following charges apply:

  • Within 24 hours of the tour departure, no refund will be given.
  • Within 2 to 3 days before the tour date 50% of the tour price will be payable unless the seat can be re-sold in which case the passenger will receive a full refund.

We reserve the right to cancel trips under exceptional circumstances such as those out with of our control. In such cases clients will be promptly informed and offered:

  • Transfer to a substitute trip or tour, or an alternative trip or if the tour is a lower cash value clients will receive a cash adjustment refund; or a total refund of all prepaid monies.

Cancellation and Refunds for private tours

  • The 20% deposit is forfeited on any cancellation, which must be notified to the company in writing by e-mail or post, and sent via recorded delivery.
  • Where the balance owing on a tour is not paid prior to the six week deadline then the company reserves the right to cancel the tour and forfeit the deposit.
  • Where notification of cancellation has been received less than six weeks prior to commencement of a tour the following schedule of refunds will apply:
    • 41-28 days before start - 75% of balance
    • 27-14 days before start - 50% of balance
    • 13-0 days before start - NIL
  • Highland Experience Tours reserves the right to cancel trips under exceptional circumstances. In such cases clients will be promptly informed and offered :
    • Transfer to a substitute trip or tour or
    • An alternative trip or tour which if a lower cash value will include a cash adjustment refund or
    • A total refund of all prepaid monies.

Cancellation and Refunds for unique tours

  • Due to the unique nature of our specialized tours i.e. X-mas & New Year tours a specific cancellation charge applies to this product - up to 7 days prior to departure 50% refund. Within 7 days - no refund)
  • Due to the fact that we use 3 star accommodation for our X-Mas & New Year tours all prices are based on two sharing a room.

General Guidelines for all tours

  • We also reserve the right to change the tour itinerary at any time due to weather, acts of God and events out without our control.
  • Unless stated otherwise, food, attractions and accommodation is not included in the tour price however; clients may be eligible for a discount when mentioning Highland Experience.
  • Due to the nature of our tours we discourage carrying children under the age of 5 years except private tours.
  • Due to the size & type of vehicles we use, luggage is restricted to one small/medium size bag; please no suitcases that you can fit in!
  • Smoking is not permitted on any of our vehicles.
  • Highland Experience recommends all passengers take our suitable travel, medical and cancellation insurance.
  • Driver tips are not included in the tour price but if deserved, greatly appreciated.
  • Please note that we operate with a minimum number of 5 passengers on all tours except private tours.

Accommodation for extended or private tours

  • We offer the complimentary accommodation booking service for the actual tour only.
  • We offer a courtesy service when booking accommodation however, Highland Experience cannot be held responsible for individual providers.
  • If you require any special arrangements to be made, please contact us once your tour booking has been made and we will strive to accommodate you.
  • Our trained staff are instructed to find the best accommodation price/type available from the customer's selected 1st then 2nd choice. You pay the provider directly.
  • A single room supplement will usually apply.
  • Hostel accommodation £14 - £17 per guest is for a dorm bed only sharing your room with other guests, we can never guarantee a double/twin in highland hostels (if you wish to guarantee a room for you only choose either B&B or hotel)
  • Bed & Breakfast £25 - £45 per guest - the options are a single (quite rare and cost more) Double (a room with one bed for two guests) Twin (a room with two single beds for two guests) or a Family room (a room with either a double & single for 3 guests etc)
  • Hotels £45+ the starting price is for a 3 star hotel if you wish to pay more please let our office staff know after you have booked and we will try our very best to accommodate your wishes.

  • Whilst reduced entry to some visitor attractions may be available, and any such will be made clear by the guide, tour prices are for transport and driver-guide services only. All cruises, visits to castles and other visitor attractions including whisky distilleries are prices separately as optional extras, along with meals and other refreshments and these are at the travellers' own expense.
  • Discount prices are offered to persons over the age of 60, full-time students and children between 5 and 16 years. We regret that children under 5 years cannot be carried.

TERMS AND CONDITIONS FOR SCOTTISH TOURS

These Terms and Conditions set out the agreement between us and you for the product that you have booked. Please take time to read and understand these Terms and Conditions as if you proceed to make a booking with us we shall take it that you fully agree these Terms and Conditions on behalf of yourself and all the members of your party.

1. Definitions

1.1 Scottish Tours is a brand name of Stagcove Limited, a Company registered in Scotland (SC165266) whose registered office is located at 78 Carlton Place, Glasgow, G5 9TH.

1.2 Within these Terms and Conditions certain phases are used and for the avoidance of doubt this is what they mean:

"Accommodation Provider" means the provider of any accommodation that is part of your Booking;

"Booking" or "Book” means a booking for a product supplied by Scottish Tours;

"Force Majeure" means circumstances that are unforeseeable or beyond the reasonable control of Scottish Tours or the Service Provider, including but not limited to war, threat of war, riot, industrial action, port closure, terrorism or the threat of terrorism, natural or nuclear disaster, fire, flood and other extreme weather conditions;

"Party Leader" means the person who makes the Booking whether on his/her own behalf or on behalf of a party;

"Product” or "tour” means a one-day tour, package tour or tourism service that is made available to consumers by Scottish Tours;

"Supplier" means the provider of the tour package;

"Significant Alteration" means any of the following:

• a change of accommodation to a lower star rating; a change to your Tour departure date of 24 hours or more;

• a material increase in the Total Price of your Tour; or

• a significant change to the location of accommodation to outwith the city, town or, for rural accommodation, the locality.

"Telephone" means using either of these contact telephone numbers 0871 200 0611 or 0141 237 4294.

" Tour Confirmation/Voucher " means an information sheet which confirms the terms of an individual Booking and contains the voucher required for pre-paid services and/or travel;

"Total Price" means the total charges (including any applicable taxes) payable to us for the Product or Tour that is the subject of your Booking;

"Travel by train” means a one-day tour, package tour or tourism service that includes, as part of the package, travel by scheduled or chartered train service.

"us" and "we" means Scottish Tours;

"VAT" means value added tax;

"Scottish Tours Channels " means the website, telephone reservation service and any other sales channels that we operate in order to facilitate the matching of booking enquiries and Tours;

"you" or "your" means the Party Leader.

2. Agency

2.1 We are not a transport, tour, event, accommodation or attraction provider. We act as a disclosed agent for suppliers who will provide these products to you. These suppliers will have their own Terms and Conditions. You should obtain and read the applicable suppliers Terms and Conditions as they may impose further conditions on this booking.

2.2 Each tour has a product code which is shown on the relevant page of our website. You can find out which supplier is providing the product that you intend to purchase from this list:

2.3 As we act as a disclosed agent for these suppliers we shall have no contractual liability to you in respect of that product. We will, however, remain liable to you if we have been negligent or misrepresented the product or we are in breach of any particular legislation.

3. Supplier Contact Details

3.1 The name of the supplier and their local contact details for the product that you have booked will appear on your Tour Confirmation/Voucher.

4. Product Queries

4.1 If you have any questions about the product that you have purchased you can contact the supplier directly. Alternatively you can telephone or email us and we shall be happy to assist you.

5. Prices

5.1 All our prices are quoted in UK Pounds and are per person. Prices are subject to change, until payment of the Total Price has been made.

5.2 We reserve the right to correct errors in the prices quoted or calculated for any product.

6. Payment

6.1 Full payment is required to be made at time of booking. Payment may be made by Visa or Mastercard credit or debit card. Payment may also be made by bank transfer; however no booking will be confirmed until we receive funds equivalent to the Total Price from you. You will be solely responsible for any bank or processing fees that are charged.

6.2 20% of the complete price of any product will be a deposit. Only in certain circumstances will the deposit be refunded to you. Otherwise the deposit is not refundable.

7. Booking Confirmation

7.1 Some products that are sold by us are "subject to availability” which means that we need to contact our supplier to ascertain if the product or tour is available. We shall send you an acknowledgement of your order and aim to confirm or reject your Booking within 24 hours, however this depends on us being able to contact our supplier. If there is availability we shall book the product for you and send you a Tour Confirmation/Voucher to the email that you have provided. If our supplier does not have availability we will notify this to you by email. In most cases we will provide you with an alternative product or tour for you to consider.

8. Duplicate Bookings

8.1 The Scottish Tours Channels will not prevent you from making duplicate bookings or from making a booking from the wrong departure city. You should, therefore, use great care when you make a booking as there will be no refund if you make that type of booking.

9. Accommodation

9.1 Accommodation is selected for location, facilities and value. Any star rating or quality classification that is quoted by us is based on our rating and are not official ratings.

9.2 Rooms are generally twin or double bedded. Single rooms are available, at the supplementary price shown on the relevant tour description page of our website. It should be noted that single rooms may be smaller than twin or double rooms. Triple or Family Rooms are also available and these may comprise of a standard twin or double room with a rollaway or fold down bed.

9.3 Accommodation is subject to availability at time of booking and may vary from that quoted on the relevant page of our website. It should be noted that the term "hotel” should not infer the provision of particular facilities such as a restaurant or bar.

9.4 Rooms are allocated on a "run of house” basis solely by the accommodation operator.

9.5 Any images shown on our website and in any publications that we might issue are intended for guidance only.

10. Meals

10.1 Unless stated otherwise on the relevant tour description page on our website lunch or dinner is not included in the price of any product.

10.2 Any special meal requirements will be made on a request basis and cannot be guaranteed.

11. Luggage

11.1 You may bring one medium sized suitcase per person which will be transported in the luggage compartment of the coach. In addition you may bring one small carry-on bag which must be able to fit in the overhead rack (where fitted) or under your seat.

11.2 Suppliers may limit their liability for lost or stolen luggage so suitable insurance is recommended.

11.3 A charge may be made for the carriage of any additional or oversized luggage, although the accommodation such luggage cannot be guaranteed.

11.4 Tours that are described on this website as "Small Group Tours” have additional restrictions on the size of luggage that you may bring. This will be shown on the Tour Confirmation/Voucher that will be sent to you once your booking has been made.

12. Times

12.1 It is your responsibility to be at the designated departure time no later than the check-in time shown on your Tour Confirmation/Voucher. The departure will not be delayed for you and if you miss the tour because you are late full cancellation charges as outlined in clause 13 will apply.

12.2 If you are travelling on a multi-day tour and miss your tour departure you may be able to join the tour en-route. In such a case you will need to make your own arrangements to reach your first nights accommodation at your own expense.

12.3 All times shown on our website are for guidance only and we take no responsibility for missed connections if the return time of your tour is delayed for any reason.

13. If you change your booking

13.1 If you need to make a change to your booking you should contact us in writing as soon as possible. We shall liaise with the supplier to see if your change can be made. If the change can be accommodated we shall make a charge of £25 to cover our administration costs. This will be in addition to any charges levied by the supplier.

13.2 If your booking involves travel by train it will not be possible to make any change to your booking.

13.3 If we are unable to make the change that you have requested we will leave your booking unchanged. If this is not satisfactory to you then you can cancel your booking in accordance with clause 15.

14. If we or the supplier changes your booking

14.1 Most tours operate subject to a minimum number of participants. Where the minimum number of passengers is not met the supplier reserves the right to cancel the tour departure. When this happens we will endeavour to find you an acceptable alternative tour. If an acceptable alternative cannot be supplied then you will receive a full refund.

14.2 No liability will be accepted for additional expenses that you may have incurred such as non-refundable hotel bookings or transport tickets.

14.3 The products that we sell are planned a long time in advance so the supplier of your product will reserve the right to make alterations to your tour such as substituting hotels, the route of the tour or the size of vehicle employed on the tour. We consider these to be minor changes which occur for operational reasons. If you would like more information about this you should contact either the supplier or us.

14.4 Where the alteration is classed as a Significant Alteration, we will invite you to choose one of the following options:

• Treat your Booking as cancelled, whereupon we will refund all sums paid by you in relation to that Booking;

• Replace your Booking with an alternative Tour of an equal value (if available) at no additional charge to you; or

• Replace your Booking with an alternative Tour of a lesser value (if available) and refund to your debit or credit card any difference between the Total Price of the two Bookings.

• Replace your Booking with an alternative Tour of a higher value (if available) and charge to your debit or credit card any difference between the Total Price of the two Bookings.

15. If you wish to cancel your booking

15.1 If you want to cancel your booking you should contact us in writing as soon as possible. Cancellation will be deemed to have occurred on the day that we receive this cancellation request. You may wish to use recorded delivery or an email requesting a receipt from us.

15.2 We shall charge the following cancellation charges, based on when we receive your written instruction to cancel your tour:

15.3 Suppliers may impose fees that are in addition to those outlined above. If these apply to the booking that you have made we shall advise you. If one person sharing a twin or double room cancels their product then the remaining passenger will be liable for any single room supplement that may be charged. This will be in addition to the charges shown above.

16. Travel Insurance

16.1 We strongly recommend that you purchase adequate travel insurance. Some of our suppliers require you to have adequate travel insurance in place as part of their Terms and Conditions. We shall advise you if this condition applies to your booking.

17. Passengers with special needs

17.1 No special arrangements are made for travellers with special needs. If you or anyone in your party requires assistance then you must be accompanied by an experienced and able-bodied companion who can cater for all your needs. Some accommodation and sightseeing may require climbing stairs or walking on uneven surfaces.

17.2 The carriage of folding wheelchairs and other walking aids cannot be guaranteed.

18. Passenger participation

18.1 We and our suppliers reserve the right to refuse carriage or the provision of services to you if your behaviour is deemed to be socially unacceptable; is likely to prevent the smooth operation of a tour or product or adversely affects the enjoyment by other passengers. In such a case you shall receive no refund or compensation. In addition you shall solely be responsible for your own transportation to the commencement point of the tour or service.

19. Refunds

19.1 No refunds will be given for a tour that you did not use due to late arrival at the departure point, leaving the tour early or by choice. This includes tours that are curtailed due to bad weather, road closure etc.

20. Complaints

20.1 We aim to provide you with a fault-free service and choose suppliers who are of good repute. If you have a complaint whilst on tour you should contact your tour host or accommodation provider to have the problem rectified. In most cases this should resolve the matter to your satisfaction.

20.2 If the matter is not resolved to your satisfaction you should contact your supplier within 14 days of the end of the tour concerned in writing. We will be happy to assist you should you need this.

21. Data Protection

21.1 Please note that when giving information for the purposes of making your Booking, you will be deemed to consent to us sending you e-mail communications about our services from time to time. We will not allow your e-mail information to be used by any other company or organisation. If you would prefer your information not to be used in that way, please contact us, giving your name and address: (i) by post to Scottish Tours, 78 Carlton Place, Glasgow, G5 9TH.

22. Force Majeure

22.1 Events of Force Majeure involve circumstances that are outside the reasonable control of the Service Provider and Scottish Tours. Whilst we will endeavour to assist you and your party where your Booking is altered or cancelled as the result of an Event of Force Majeure, we regret that the alternative arrangements detailed in Clause 14 will not apply.

23. Liability

23.1 Subject to Clause 23.4, in no event will we be liable to you, in contract, delict (including negligence or breach of statutory duty) or otherwise howsoever and whatever the cause thereof for any loss of profit, business, contracts, revenues or anticipated savings, increased costs or expenses, special, indirect or consequential damage or loss howsoever arising out of a Booking.

23.2 Any loss or damage suffered by you or any member of your party which results from the failure of a Service Provider is limited to the amount that you or that member of your party is entitled to claim from such Service Provider under its terms and conditions and/or any applicable international convention.

23.3 Our total liability to you and the members of the party covered by the Booking in respect of any costs or losses directly associated with that Booking shall in no circumstances exceed in aggregate an amount equal to the total sums paid by you to us in relation to that Booking

23.4 Nothing in this Clause 23 shall seek to limit or exclude our liability to you for death or personal injury caused by our negligence.

24. General

24.1 These terms and conditions, together with the relevant Tour Confirmation/Voucher and any relevant supplier terms and conditions constitute the entire agreement between you and us in relation to that Booking. Nothing in this Clause shall exclude the liability of either party for fraud or fraudulent misrepresentation.

24.2 In the event that the whole or any part of a provision may prove to be illegal or unenforceable, the other provisions of these terms and conditions and the remainder of the provision in question will remain in full force and effect.

24.3 The construction, validity and performance of the Booking and these terms and conditions shall be governed by the law of Scotland and the parties submit to the exclusive jurisdiction of the Scottish Courts in as far as permitted by law.

Terms and conditions for Coach Tour bookings

Terms & Conditions of bookings of Gray Line Scotland Ltd. Once Gray Line Scotland confirms your booking a contract is made between Gray Line Scotland and you upon the terms and conditions set out below. Your statutory rights are not affected.

Prices – Prices on this website are based on known costs and exchange rates at November 2010.

Senior Prices - age 60 years+.

Students - ID must be shown on the day of travel.

Children - Children under 16 yrs must be accompanied by an adult. All occupants on the coach must occupy a seat and use the lap belt provided. Children under the age of 4 years must use a suitable seat restraint supplied and fitted by the parent/carer. Children under 4 cannot travel on the 12-hour Loch Ness tour. Generous child rates apply. AA & AAA discounts. Discount card must be shown on the day of travel.

Cancellations - If your booking was made through one of our authorised agents, all amendments and cancellations must be made through them.

Notice Period Cancellation Fee 1, 2 & 3 Day Tours

7+ days = Full refund.

Less than 7 days before departure, No refund unless the seats can be resold. The above are a guideline only and subject to management discretion. Any increase in price will be notified to our agents and in our sales outlets. We will endeavour to remove all out of date promotional material.

Accommodation: We offer a courtesy service when booking accommodation However Gray Line cannot be held responsible for individual providers. We aim to visit all providers in person but the standard cannot be guaranteed. A single room supplement will apply.

Booking/Acceptance - A booking is accepted by us only when we, or our agent, have received payment in full. On receipt of your payment, subject to availability and at our discretion, Gray line Scotland will reserve your place on your tour. A contract is only made between you and us upon your booking being confirmed and accepted by us and our communication thereafter to either you or our travel agent.

Courtesy Collection Service - For your convenience we offer a wide choice of Hotel / Guest house pick up points. If not from the main entrance to your accommodation we aim to collect you from within walking distance. Drivers have to work under strict legal and time restrictions; therefore you will be dropped back at convenient stops, depending on the traffic conditions. Insurance - There is no travel insurance cover included in the price of the ticket.

Weather Conditions - Under no circumstances can we be held responsible for weather conditions, nor can any ticket be cancelled or amended by you at any time on the basis of weather conditions. Cancellations - We reserve the right to vary, modify or cancel any itinerary, either part or wholly due to circumstances beyond our control. If this is necessary, we will substitute alternative arrangements, or at our discretion provide a full refund.

Luggage – Storage is available for small pieces of luggage at the discretion of the driver and at your own risk.

Accident or Loss - We have no liability for loss, damage, delay, inconvenience, however caused, unless due to our employees negligence, in which case our liability is limited (except for death or personal injury) to a maximum of the refund of the tour cost.

Prices Do Not Include - Gratuities to the Driver/guide, Lunch or admissions to attractions unless specified.

General Conditions - We reserve the right to cancel any tours due to lack of demand and also to use vehicles as dictated by demand.
